CHAPMAN, Justice. The first question presented by this record for adjudication is whether or not the plaintiff-appellee Irene Zaleski Spinella, by the evidence appearing in the record, carried the burden of establishing the existence of a common law marriage between her and the defendant-appellant Michael Spinella. The parties were each competent to contract marriage on March 27, 1948. On said date, according to the testimony, the plaintiff-appellee accepted a proposal of marriage as made to her by Michael Spinella. On this day they established their residence at 6570 Allison Road, Miami Beach, Florida, which home at the time was owned by the appellant. The parties lived together in the aforesaid home until their return from Europe in 1950.
